Guidelines for importing All Terrain Vehicles & Off Road Motorcycles into Canada Transport Canada receives many calls from Canadians wishing to import scooters, off road recreational vehicles, and various motorized “fun” vehicles, into Canada from foreign countries. Many of these potential importers are surprised to learn that there are regulations that must be met as a condition of importing these vehicles into Canada. The Motor Vehicle Safety Act and regulations administered by Transport Canada, is the legislation that establishes the safety standards for vehicles manufactured and imported into Canada. Under this legislation, the importer is responsible to ensure that the vehicles imported comply with the applicable standards prior to their importation into Canada. The importer is also responsible for issuing a notice of defect (recall) for any defect in the design or manufacture of the vehicle after it is sold in Canada.
The attached information is designed to provide importers and foreign manufacturers with a summary of the information and the Canada Motor Vehicle Safety Standards (CMVSS) applicable to these vehicles, so that the determination of vehicle admissibility can be assessed before attempting to import vehicles into Canada.
The information included in this application refers to two classes of vehicles, specifically all terrain vehicles (ATV) and restricted use motorcycles (RUM ). (There is a similar publication for motorcycles and “limited speed motorcycles”). The main difference between a RUM and a motorcycle is that the RUM is designed for off road use only. ATVs and RUMs are defined in the Canada Motor Vehicle Safety Regulations as follows:
“all-terrain vehicle" means a wheeled or tracked vehicle, other than a snowmobile or work vehicle, designed primarily for recreational use or for the transportation of property or equipment exclusively on undeveloped road rights of way, marshland, open country or other unprepared surfaces.
Example of an ATV
-“restricted-use motorcycle" means a vehicle, excluding a power-assisted bicycle, a competition vehicle and a vehicle imported temporarily for special purposes, but including an all-terrain vehicle designed primarily for recreational use, that:
(a) has steering handlebars,
(b) is designed to travel on not more than four wheels in contact with the ground,
(c) does not have as an integral part of the vehicle a structure to enclose the driver and passenger, other than that part of the vehicle forward of the driver's torso and the seat backrest, and
(d) bears a label, permanently affixed in a conspicuous location, stating, in both official languages, that the vehicle is a restricted-use motorcycle or an all-terrain vehicle and is not intended for use on public highways;
Examples of RUMs
Information required by Transport Canada prior to importing All Terrain Vehicles (ATV) and Restricted use Motorcycles (RUM) into Canada.
The following items are a summary of the information Transport Canada needs to determine if the imported vehicles conform to the applicable Canada Motor Vehicle Safety Standards (CMVSS). This information is required to be submitted to Transport Canada prior to importation of the vehicles into Canada.
Note: Due to the high volume of applications, Transport Canada can only process applications that are complete and contain the information in the order listed in this document. Incomplete or randomly submitted documents will be returned.
1. Provide written confirmation from the foreign manufacturer on the co***ny’s letterhead and mailed directly from the foreign manufacturer providing the following:
a) Confirmation that the Canadian importer is designated by the foreign manufacturer to import their products into Canada.
b) Pictures with model names of the vehicles that the foreign manufacturer has certified to the applicable CMVSS and authorized your co***ny to import into Canada.

a) Submit a “FOREIGN MANUFACTURER REGISTRATION FORM” completed and signed by the foreign manufacturer.
b) Provide the Federal or Provincial registration certificate and the GST number of your co***ny.
3. Warning Label
a) Provide a photograph of the placement of the warning label (label samples below). The warning label should be in a conspicuous location, i.e. the rider should be able to view the warning label while seated.
b) Provide Transport Canada with a sample of the warning label material used.
4. Compliance label
a) Provide a compliance label completely filled in (see sample below).
b) Lettering on the compliance label shall be in block capital letters at least 2 mm in height.
c) Provide a photograph of the placement of the compliance label, it should be located as close as to a permanent part of the motorcycle as practicable to the intersection of the steering post (goose neck) and the handlebars so that it is easily readable without moving any part of the motorcycle except the steering system
d) Provide a sample of the material selection used for the compliance label.
5. Vehicle Identification Number (VIN):
a) Provide a sample VIN with a VIN breakdown with the information necessary to decipher the characters in the vehicle identification numbers.
Note: Position nine, the check digit, must comply with the requirements of the CMVSS 115.
b) Please provide Transport Canada with a copy of the WMI designation letter from the foreign issuing body. If the foreign manufacturer cannot obtain a WMI for the class of vehicle you wish to import, please contact us.
6. Technical Standard Document (TSD) 108 – Lamps, Reflective Devices and Associated Equipment (link to TSD 108 below).
ATVs and RUMs are required to have five reflex reflectors permanently affixed to the vehicles. Please provide pictures of the mounting locations paying special attention to the following:
a) Submit photographs showing a side and rear view of every type of vehicle your co***ny intends on importing, take the photo at seat height.
Please note that these photographs must be sufficiently clear and detailed to enable an inspector to determine if the ATV-RUM complies with TSD 108 - Lighting System and Retroreflective Devices.
b) If the reflectors have the “SAE A or DOT A” markings on the lens, provide a photograph showing the SAE lens markings. If the reflectors do not have the “SAE A or DOT A” markings on the lens, provide records of testing to demonstrate compliance with TSD 108.
c) Reflectors mounted in the front of the vehicle are required to be amber (orange) in color. Reflectors mounted on the rear and back of the vehicle are red in color.
d) Reflectors are required to be permanently mounted to the vehicle.
e) Side reflectors are required to be vertically mounted on the side of the vehicle. Front side (amber) reflectors are to be mounted as far to the front of the vehicle as practicable and rear side (red) reflectors are required to be mounted as far to the rear as practicable. A red reflector shall be mounted vertically on the rear of the vehicle. Reflectors that are not mounted vertically as described above, i.e. affixed to a contoured fender, body fairing or a similar non vertical surface, must be acco***nied with test documentation to demonstrate compliance with the applicable SAE J594f recommended practice.
Note: Suggested locations for reflectors are on grab bars and utility racks providing they are mounted vertically and as far to the front and rear as practicable.
f) Provide evidence that the reflectors are mounted at the appropriate height. (Use a measuring tape in the photograph to indicate the height of the reflectors)
i. Reflectors are required to be mounted at a height above road surface measured from center of item on vehicle at curb mass, not less than 380 mm (15 inches), nor more than 1530 mm (60 inches).
ii. Reflectors must not be mounted behind tires, baggage, mufflers, inside wheel wells and fenders.
