SELLER SHALL ALSO INFORM THE BUYER OF THE VESSEL’S NAME, VESSEL’S CAPACITY, NUMBER OF HATCHES, NUMBER OF CARGO AND PARTICULARS OF THE VESSEL’S READINESS TO EFFECT OPERATIONS THROUGH ALL HATCHES AND AT COMPLETION OF LOADING THE QUANTITY LOADED PER CHAMBER AND THE QUANTITY SHIPPED. * THE VESSEL’S MASTER IS TO ADVISE THE BUYER’S AGENT AT PORT OF DISCHARGE THE VESSEL’S NAME, DATE OF ARRIVAL, VESSEL CAPACITY, NUMBER OF HATCHES/NUMBER OF CARGO CHAMBERS, QUANTITY LOADED PER CARGO CHAMBER AND THE PARTICULARS OF THE VESSEL’S READINESS TO EFFECT CARGO OPERATIONS THROUGH ALL HATCHES. * THE VESSEL’S MASTER SHALL GIVE 20 (TWENTY) DAYS AND 07 (SEVEN) DAYS PROVISIONAL NOTICE AND 72, 36 AND 12 HOURS FINAL NOTICE OF THE VESSEL’S ESTIMATED TIME OF ARRIVAL AT PORT OF DESTINATION TO THE BUYER’S AGENT AT THE PORT OF DISCHARGE. SUCH NOTICES SHALL BE EFFECTED DURING NORMAL BUSINESS HOURS AND WHETHER IN BERTH OR NOT. * LAY TIME SHALL COMMENCE FROM 13:00 HOURS IF VESSEL NOTICES OF READINESS TO DISCHARGE IS GIVEN PRIOR TO NOON AND FROM 08:00 HOURS OF THE NEXT WORKING DAY IF NOTICE IS GIVEN IN THE AFTERNOON. IF THE PORT IS CONGESTED, THEN THE LAY TIME IS TO COMMENCE 24 (TWENTY-FOUR) HOURS AFTER NOTICE OF READINESS IS GIVEN. THE BUYER IS RESPONSIBLE FOR THE PRODUCT DISCHARGE. * THE AVERAGE DISCHARGE RATE SHALL BE 1.500 TO 2.000 METRIC TONS (± 5%) PER WWD OF 24 (TWENTY-FOUR) HOURS. IF THE PORT OF DISCHARGE HAS A LOWER AVERAGE DISCHARGE, THE DISCHARGE RATE WILL BE ADJUSTED ACCORDING TO THE PORT’S CAPACITY. THE TIMES FROM 17:00 HOURS ON SATURDAY TO 08:00 HOURS ON MONDAY AND FROM 17:00 HOURS ON THE DAY PROCEEDING TO 08:00 HOURS ON THE DAY SUCCEEDING ANY HOLIDAY ARE EXCLUDED EVEN IF USED. * SHOULD THE VESSEL BE DISCHARGED AT THE RATE LESS THAN THE AVERAGE, THE BUYER SHALL PAY TO SELLER DEMURRAGE AT A RATE STIPULATED IN THE TIME CHARTER PARTY AGREEMENT AS PER RUNNING DAY AND PRORATED SHARE FOR ANY PORTION OF ANY RUNNING DAY. * IT IS AGREED THAT DEMURRAGE BE SETTLED BY THE VESSEL’S MASTER AND BUYER’S SHIPPING AGENT WITHIN 05 (FIVE) DAYS FROM THE RECEIPT OF THE VESSEL MASTER’S INVOICE. * ALL TAXES OR LEVIES IMPOSED BY THE COUNTRY OF DESTINATION, HAVING ANY EFFECT ON THIS AGREEMENT ARE FOR BUYER’S ACCOUNT AND HIS SOLE RESPONSIBILITY. ALL TAXES OR LEVIES AND PORT DUES IMPOSED BY THE COUNTRY OF ORIGIN, HAVING ANY EFFECT ON THIS AGREEMENT ARE FOR THE SELLER’S ACCOUNT AND HIS SOLE RESPONSIBILITY. * SHOULD THE VESSEL BE REQUIRED TO SHIFT FROM ONE BERTH FOR ANOTHER PORT OF DISCHARGE, THEN THE TIME USED SHIFTING SHALL BE FOR BUYER’S ACCOUNT. IN THE EVENT LIGHTERAGE IS REQUIRED AT THE PORT OF DISCHARGE, THE SAID EXPENSES ARE FOR THE BUYER’S ACCOUNT. 第16条 ARTICLE 16 – INSURANCE * ALL RISK MARINE INSURANCE POLICY TO BE COVERED BY THE SELLER. * SHIPMENT EFFECTED BY VESSEL OF NOT MORE THAN 20 YEARS OF AGE MAXIMUM. OVERAGE PREMIUM OF VESSEL WHICH IS OLDER THAN 20 YEARS OLD, IF ANY, FOR BUYERS CARE AND SELLER’S ACCOUNT SUBJECT TO THE RATE STIPULATED BY AN ACCEPTABLE INSURANCE CO***NY. 第28条 ARTICLE 28 - CONTRACT SIGNATORIES THIS CONTRACT SHALL BE GOVERNED BY AND DONE ACCORDING TO THE RULES OF THE INTERNATIONAL CHAMBER OF COMMERCE (LONDON, UNITED KINGDOM) AND SUBJECT TO THE INTERPRETATION OF INCOTERMS 2000 EDITION AND AS AMENDED TO APPLY. 过奖!各人水平参差在所难免,个人也不敢***怎么厉害。通过辩论一种技术,同样主要的是要否定那种目空一切的训人口气。即便任何一个业务水平高者,也不见得业务做得好,更不见得挣得多,及住豪宅开名车。如果L/C单证技能高,但充其量只能做一个单证员的,对女性犹可,对男的则不能不说是一种悲哀。个人在广州读书时,整天运动,无心向学,心不在焉,那时的成绩是中下的,只是出来工作后才逼上梁山。自从上半年入得此论坛以来,对于各方面的辩论,据我所知,从未有我在广州的任何一位外贸同学参与进来,事实上我不敢让他们知道我在论坛上进行了如此浩大的一场辩论,否则他们都会笑我!如果让那么多比我高明的同学进来辩论,呵呵,那又会是一个什么样的波澜壮阔的场面啊? 以上贴出的主要是关于海运和保险的,也有缩写如 WWD,其它还有很多缩写未贴出,如 FFDLC,POF,SA,UNH,等等,不贴太多了。 qdhttp 多次发电邮给我,意欲交流,故我特公开在此交流,他却又玩失踪,真没意思……不想交流也说一声嘛,免得我老记着这事…… 本帖子2006-11-29 12:07:40由BruceHuang进行编辑!!
